signature not recorded on tenant at will agreement because apartment was rented

Rented apartment to a woman. Received first and last month's rent from her. Her boyfriend moved in. Domestic abuse reported 1/3/05. She filed a 209A. On the same day he was to be served, he was hit by a car. In hospital for approximately one month. He was never served because of hit and run and in hospital. She thought he would be in hospital for 3-4 months. Did not renew 209A. He is being released from a rehab center on Friday 1/28. Brother is a cop. Said she has to take him in. He won't hit her because he's disabled now. I didn't rent to him. No signature on file. Do I have to allow him to move back in? He is disabled now; think he can't walk, etc. He is a batterer. He will need additional surgery. No insurance. Rehab is putting him out because of this, I believe. Not sure though. Does not have income. She will need to support him. I don't want him here. He has family, a brother. Of course he doesn't want him either because of temper issues. Am I legally bound to allow him to re-enter the premises? Need answer ASAP
