This is not about you, it is about your girlfriend and the children... they are the only perple whose "rights" will be considered by the court. Under our laws, the court will consider what is in the CHILDREN'S best interest when making custody decisions. Unless the terms of your probation/parole or release prohibit you from being around children, then you should not be subject to arrest or any criminal liability for living at your girlfriend's home. That said, when determining where the children should reside, the court will look at what is in their best interest, not what is in the interest of either parent, and certainly not what is in the interest of a non-parent. Your girlfriend should retain an attorney to represent her if she plans to fight the change in custody since there is a presumption that being around or living with a sex offender is not in the children's best interest.
