Legal Question in Legal Ethics in Massachusetts

Being sued by ex employer for allegidly stealing customers after I left. I am a tax preparer many of my clients are close friends and family who have choosen to have me process their taxes regardless of the office I work out of. Many of my friends were bought on by myslef as well as my husband and chose not to return by their own accord. I did sign an agreement that I cannot practice taxes for a period of one year after I leave. ( i do not have a copy) Do I have any defense for these alligations. As a tax preparer (7 years) I work seasonally can I really be prevented from working for 1 year with no income and no option for unemployment form my previous employer?

It is very difficult to respond intelligently without knowing much more about the surrounding facts, specific details of any operable non-compete, severance agreement, etc. I strongly encourage you to consult with counsel about this, especially b/c you have already been sued. It is also likely there will be an expedited hearing soon requested by the other side for an injunction and/or temporary restraining order, which could drastically affect (i.e., restrict) your rights pending resolution of the litigation. So, seeking counsel immediately is especially critical here. There may be ways to negotiate some or all of this away in short order, but this should be handled carefully by experienced counsel to maximize your leverage and rights.
