Legal Question in Legal Malpractice in Massachusetts

what are chances of winning in small claims court with a signed waiver? Customer signed one time in sept. 2009 and pet has been groomed many times since. The form has other client signatures on it and it reads: I understand that occasionally grooming can expose a hidden medical problem or aggravate a current one & my pet may be at risk for mental or physical stress during or after the grooming. Also i understand that close clippings for sensitive skin or trimmings on any active pet can cause nicks cuts or skin irritations. I hereby grant permission to ____ to obtain emergency vet treatment for my pet if so needed and will not hold this grooming establishment responsible for any vet bills or other fees now or in the future. I also did offer to pay 1/2 the vet bill, but customer refused.
