If you sue a insurance company for medical malpractice , and win the suit

are you able to elect that medical coverage by the same insurance co years later?

You wouldn't typically be suing an insurance company for medical malpractice. Doctors provide health care, and insurance companies provide health insurance. That being said, you may have claims for unfair or deceptive settlement practices. I'm not sure I understand your question, but I don't see any reason why you wouldn't be ablt to select similar coverage by the same insurer.
