Legal Question in Medical Malpractice in Massachusetts

wrongful death

my mother went into the hospital prior to new years with diagnosis of adhesions from prior surgery (bowel obstruction. Adhesions removed and supposedly all was ok with anticipated discharge. On 1/11, my sister (health care proxy) was called by the radiologist and asked to come in a sign a consent form so that an abcess that was found could be tested for infection - seeing as though my mother had had a massive stroke and was in the icu. we were never informed of this at all. my sister questioned this and then later received a call from her doctor who said she was calling to update my moms status, when my sister asked her why we werent notified she said that ''you could've called me''. we were later called to the icu to hear that my mother needed a miracle to survive. She was on a respirator until we got there, then stopped the machine at 1:45am, shed died at 5:51pm. The death cert states reason for death: bowel obstruction, sepsis. and onset between cause and death of 12 days. we dont feel this is accurate. we were never aware of any sepsis. and there is no mention of stroke. my mother was also in a state of lethargy and confusion while in the hospital (not her baseline) with unknown reason. please help us.

Re: wrongful death

Cases involving medical malpractice and wrongful death often require careful investigation beginning with a review of the medical record and autopsy report by an expert. In your mother's case, an investigation would attempt to answer at least two questions: 1) what was the cause of her death, and 2) were there actions that the doctors and nurses could and should have taken that could have saved her life and avoided what appears to have been a stroke.
