Dangerous Tree

There is a very large dead tree about 10' outside our property, but leaning over toward our house. Half of it has already fallen down (fortunately, into a vacant lot), but when the remainder comes down, it will severely damage our house and possibly cause injury. Does the owner of the property on which it sits have any legal obligation to remove it before that happens?

The owner knows the tree is old and also knows the remainder of the tree will likely fall. He therefore may be liable for any damage caused.

You may also use self-help and cut that portion that overhangs onto your property. But be sure to only cut that portion that actually overhangs onto your property.
