Legal Question in Personal Injury in Massachusetts

Default Judgment

I sued someone for personal injuries and they never filed an answer. My complaint did not specify a specific amount of damages b/c it was for pain and suffering. What type of motion do I file in order to have the judge calculate my damages and enter a judgement in that amount for me?

If the other person failed to answer, and assuming you have good service, then there is a form in court to seek a default judgment. A military affidavit is also required.

There should be a hearing for the assessment of damages where you can make your case to the judge.
