house insurance rejected it so my brother is suing me

My brother and i were horseplaying and i ended up hitting him in the scrotum from behind. i was aiming for his rear end when he was doing a humping motion on his girlfriend in front of my kid so i was asking to stop. He refused to go to a freecare hospital even though he has no health insurance of his own. He put a claim into my house insurance for the accident but they denied his claim because he didn't submit the paperwork required on time. He now plans to sue me for medical expenses and punitive damages. Now he claims i purposely and maliciously kicked him (he claimed it was an accident for the house insurance). Can he do this? I've offered to pay the medical bills but he wants to profit from this. I don't know what to do. Please help.

Your "brother" has a right to file action just like any other person. From your note, I cannot see what damage this caused, or claimed by your brother. It would be in your interest to consult with an attorney so that you can share with him what happened & what you need to do to protect youself.
