Legal Question in Personal Injury in Massachusetts

was involed in acc in Jan. As i came over hill in the left lane i was confronted with a p/u truck accross the right lane having spun out due to black ice howeverin the right lane an suv had stopped to watch thereby cauusing me to put on my brakes and learn what black ice is .. I had to think fast in order to avoid either vehicle and pulled off the left side into woods missing guard rail by inches ,after hitting a few trees finally came to a stop and my car was totalled . wrote to both ins co's of the two vehicles and was told they weren't responsible as i don't have collision my ins co doesn't want to get involved , my question do I have any recourse on this matter or am i out of luck ?

While the law is clear what a finder of fact would make of all this is unclear. If you feel strongly about it hire a lawyer and pursue for reimbursement. There are no guarantees how this would come out. If you did not buy collision coverage I guess you decided you would accept this outcome rather than pay for protection. Best luck. Regards, JBS
