Legal Question in Personal Injury in Massachusetts

My mother is 91 years old and was hospitalized with change of mental staus relative to changes in her medication. She is very hard of hearing and blind. She became aggrestive with staff and was transferred to a Gerriatric Pshch unit while she recovered from her delirium.Treatment required that she particapte in groups, one to one meetings etc. She wore street clothes. I brought in her hearing aids to help her participate in treatment. These cost her $4000, they now cost $5380. She kept them in her bedside table and they went missing. They were never found. We live in Massachusetts. I contacted the nurse manager and want them to be replaced. The hospital just contacted me and offer to pay only $2000. I spoke to the Director of Nursing and refused the money since my mother is on a limited income and would have to pay $3380. The DON referred me to the Patient advocate. I work in a hospital as a nurse and realize that their role is generally powerless other then to pour "oil on the water" What can I do to get a replacement?

Make written demand personally or through an attorney suggesting small claims action and perhaps make demand under Consumer protection law MGL chapter 93A. Good Luck!
