Legal Question in Real Estate Law in Massachusetts

My neighbor advised me is he putting up a fence in the backyard to divide the property. In the deed the back and front yard are considered common areas. Can he put up a fence without my permission? Also, he put up 2 security cameras on the house. One faces the front yard and one faces the backyard which are both common areas. Can he do that. Anytime I am in either yard he is sitting in his house watching my every move. Isn't there a privacy issue?

Without reading the deed restrictions no one can be definitive. If this is a two-family Condo, he cannot put up a fence in the common areas without the consent of the other owners of the common area property.

As for the security cameras, he can put such things up on his home provided that the area he has attached it to is not a common area. I would suggest you see an attorney in your area to review the deed or master deed and if applicable any Condo documentation.
