Legal Question in Real Estate Law in Massachusetts

paper street usage

There is a "paper street" between my house & my neighbors. For 40 years both of us have taken care of this land, cutting wild growth, putting down crushed stone & shoveling. We both park cars on this land & my neighbor has recently hot topped an area to park on. The town has never objected to our use of this land. at one time I asked the town's permission to buy a portion of this "paper street" but was told the town did not own it and was not sure exactly who did own it. There is a lot of land in back that would only be accessible by making this "paper street" into a real street. Someone is now trying to buy that lot and turn this "paper street" into a real street. What are our rights?

I'd have to see the documents ... what are your street addresses?

I advise you to presume that, if we decide that you have have rights worth protecting, that this will be a lengthy and expensive process; so your first level of analysis will be, do we have rights worth protecting, what is the liklihood of success, what is the process involved and then - is it worth it, both financially and in your personal time and effort.
