Quitclaim Deed for timeshare

Bought a timeshare with boyfriend, we broke up and he promised to give it to me, has not done so. Tried to buy him out but really just want to sign property over to him. Can I get a lawyer to draw me up a quitclaim deed for myself? Timeshare has negated on several promises made. Feel ripped off all the way around and just want out.

It is not really clear what you want to do. If it is to give the timeshare your boyfriend simply giving him a deed or having a deed may only partially achieve your goal. If you have a mortgage or note on the timeshare, you will still be liable for payments.

If you want the timeshare, then your boyfriend has to give you a deed. If your both don't want it, then you can sell it. If one of you does not want to sell, then the other has a right to file a petition for partition to force the sale of the property or separate it. Such as if it is for two weeks, one gets one week and the other gets one week.

In the end to give you reasonable advice some additional information is needed:

1. Where is the timeshare?

2. Do you owe money on it, make payments other than association dues or fees?

3. Does you ex bf want it?

You should check with an attorney in your area and give him a copy of the agreement between you and the timeshare company.
