Legal Question in Real Estate Law in Massachusetts

Seller breahes offer not signing P&L agreement

Seller accepted my offer to buy his house. At the time of P&S he decides not to sell it to me. Is there any chance for me to get the house if I sue the seller?

If you have seller's signature on a written offer you can perhaps use that as a Purchase and sale provided it has the essential elements of a contract. Please feel free to contact me if you have further questions.

Re: Seller breahes offer not signing P&L agreement

It depends upon the language in the offer that was accepted. If the offer meets the requirements for a contract then you might have a basis for filing a suit for specific performance. However, if the offer provides has escape language in it then you are unlikely to be able to prevail.

A suit for specific performance can be expensive.
