Legal Question in Real Estate Law in Massachusetts

I sold a piece of land several years ago. Part of my driveway is located on this property. The owner has now blocked the driveway completely and placed blocks, logs and bricks along the property line. I no longer have access to my garages and emergency vehicles cannot get near one of the apartments in the building. I feel I have a case but don't know how to begin. I do not have the resources to hire an expensive attorney.

I had a case like this several years ago. You need to consult an attorney about this. The title has to be examined as well as records from town or city hall. The lawyer needs to know how the driveway came to be on the other person's property. How long has the driveway been there? Who maintains the driveway? In all probability, you can go into court and get a restraining order to make him remove the obstructions. If you win the case, the court will order a permanent injunction against the neighbor.

Our office has handled a fair number of boundary and driveway disputes. Driveway disputes are fairly common, especially where unity of ownership preceded conveyance of a portion of land. You will need an attorney to assist you in litigating this matter but it is likely something that can be remedied.
