I am so sorry.

Your girlfriend should seek all necessary medical attention, and I strongly recommend that she contact the Victim Rights Law Center at www.victimrights.org. They will help your girlfriend take whatever steps she feels she needs to take in response to the sexual assault.

To answer your question in general terms, there are no magic words or physical actions that are required on the part of the victim. If your girlfriend was touched or sexually assaulted in any way without her consent, and if she believes she was raped, then she was raped. Whether the situation would provide for criminal or civil remedies depends upon the details of the situation.
