Legal Question in Social Security Law in Massachusetts

I am on Disability and receive SSI. Recently I was in an automobile accident. My car was totaled and I was awarded money to replace it, which I did. I was also awarded compensation for my injuries. Can I keep this money without causing deductions to my SSI payments?

I'm very sorry to hear that you were in an accident.

One difference between SSI benefits and SSDI benefits is that SSDI benefits are not means tested. On the other hand, SSI benefits (and others) are means tested, and you are right to be concerned that a cash settlement may prevent you from receiving your benefits. In some cases, a special needs trust can be used to make sure that your cash award does not interfere with your right to collect certain benefits. You should really sit down with an attorney to discuss options.
