Legal Question in Social Security Law in Massachusetts

SSA overpayment

I've recently recieved a letter of

overpayment dating back to 2002. I

was given 10 days to respond to a

Baltimore, MD social security office but

given no #. After calling my local SSA

in lynn I was told my checks are to

stop and not to cash July's check

which has been processed already. I

have been working part time to

supplement my income and never

recieved any notification that I was

making around 72.00 a month too

much and they now want the last 5

years of the entire ammount paid to

me repaid! This runs into thousands of

dollars. They were given my pay stubs

when I started work and I've filled out

all forms sent to me. I am 100%

disabled and this will not change, yet

they say I'm no longer entitled to a

check. They do not want me working,

do not intend to send my SSI checks,

and expect to be repaid. Please let me

know what to do. Thank You for any

help or direction you may be able to

assist me with.

Re: SSA overpayment

You should immediately seek an appeal to at least delay the process. However, the system is fairly firm about work while disabled, and the regulations are fairly clear. You have an uphill battle to win an appeal, as under the regulations you are supposed to know (and watch) how much you can make.
