Legal Question in Tax Law in Massachusetts

I recieved the first time home buyers credit of 8 thousand dollars in my name only not my husbands. We both own the home together but due to domestic violence he is in jail and I can`t afford the house on my own. I need to move but have been told I will owe the IRS that money back if I don`t own my home for 3 years. Is there anyway out of this?

There are a number of statutory protections for the victims of domestic violence (I'm very sorry by the way). However, there are other problems associated with selling, including the fact that your husband retains an ownership interest in the property, and you may have to "petition to partition, in order to sell the property anyway - if he does not want to sell it. Bottom line, speak to a lawyer.

You said money was an issue, so ask about "limited assistance representation" the Courts have recently allowed lawyers to offer piecemeal representation, which may be less expensive.
