Legal Question in Telecomm Law in Massachusetts

unauthorized pictures of minors

I asked a question a little while ago about unauthorized pictures of my minor children(her half siblings)on my stepdaughter's facebook page. Thanks for your responses so far.I probably should have been more specific about the situation. She has been told that her father and I both do NOT want pictures of the children on the internet(as a matter of fact I have written to other networking sites and they have removed pics she posted with no problem).

She has since added pics to facebook, but when I contacted them they said the pictures don't violate their terms of service so they will not remove them.My question is:Does the parent have to give permission to have their children's pictures posted somehere? And if so doesn't facebook HAVE to abide by these rules?

We will definitely speak to her about this again, and she will have to take them down to keep harmony at home, but my issue is now also with the website for not responding to a parent's concern. Thanks in advance.

Re: unauthorized pictures of minors

The website is under no obligation to remove pictures posted by a subscriber unless the protesting party can show violation of the law (ie. Copyright, Pornography, etc)... newspapers, artists, etc. take photographs every day and publish them without consent.
