Legal Question in Wills and Trusts in Massachusetts

I live in the state of Massachusetts.

My mother died three years ago and we are now selling her home.

Can I relinquish rights to the estate at this time?

If the estate is still open and you have not been deeded the property by the executor, you may be able to relinquish your interest in the property.

However, without knowing more, this could be deemed a gift and could result in a taxable gift, although you may have sufficient tax credits to cover the value of your portion of the estate.

More Facts are needed to let you know what you can or cannot do at this time.
