divorce rights

i am a u.s. citizen, legally married in

the country of mexico in 1994. my

husband is mexican. three children

ages 10,8, and 6. children both u.s.

and mexican citizens. we have lived

in mexico during our marriage of 13

years. what are my rights????? is it

better for me to file for divorce in the

u.s.???? or mexico???? i currently

have an fm3 which states that i can

travel freely between mex and the

u.s. the fm3 states that i am

unemployed and dependent upon my

husband. also, what are my custody

rights???

According to the data you gave, you can divorce either in US or M�xico, however I, has a mexican attorney, would advice that you divorce where your husband has his main income or where he works. [email protected]

You can get a divorce sentene in US or Mexico. Is your choiche. If he is agree, is possible in US. If not, is necessary come to Mexico. I suggest you get a divorce sentence in US because you want to live in US (I guess). You have all custody rights because your kids are minors (12 years or less). With FM3 you can travel in all Mexico. If your FM3 no contains restrictinos, feel free for travel in Mexico.
