Legal Question in Family Law in Michigan

My children have UGMA Mutual Funds and my ex-husband has remained the custodian on the accounts. We have joint custody. He has spent the funds without my consent for their private school tuition. The private schooling is listed in the divorce judgment, and dictates that the children must attend the school so long as the father continues to pay. Can he use these funds to pay for the private schooling given the stipulation. Can he act independently to spend the funds on anything he deems for the benefit of the children. If not, is there any recourse to recover the children's funds. Thank you.

It depends on how the Judgment is worded. If it's not clear, you would need to file a Motion with the Court for a ruling on whether what he did was appropriate. If not, the Judge would likely order that he has to repay the money. Good luck.
