Legal Question in Family Law in Michigan

My ex wants me to have custody of my 12 yr old son again in MI. I had sent him to CA to be with his father, but now his wife says, send the kid back, or we get divorced. We wish to avoid the court system due to lack of money and time, just get a statement notarized for now indicating amount of child support for him to pay and change of custody rights. While I understand it's not the BEST way to go, is this good enough for me to apply for some state aid, tax returns, MIWORKS, MICHILD, and would it hold up in court if/when he fails to pay?
