Legal Question in Family Law in Michigan

Hi my name is Joel Manley

I live in Grand Rapids MI

The question is about my grandson his father and mother were never maried and she has custody of and she refuses to let my son and or for that mater any of the family to have any kind of visiation is there any laws that can help my son myself or other menmbers of our family get visaiton and or unsupervised visiation ?

We have tried many many times I have only seen him around 5 or 6 times and he just turned 8 yrs old yesterday 12-14-09.

His mother is always to busy for any of us to see him she always says make an appoitment but than never follows thru with it.

Is there anything i can do as a grandparent it could be a wonderful christmas if i could have him for a little bit on christmas eve if at all.

Hi, Joel. Sorry about your troubles. I'm assuming from your question that there has never been a court case. If that's the case, your son can file a custody action, asking for certain visitation. He will probably be ordered to pay child support as well if he doesn't already. Once there is a Court order, it will specify when your son gets visitation (parenting time). If there is already a court case and she's not following the Court order, your son can file a Motion to Compel her to follow the Order. Hope this helps. Good luck. The first step is to get your son to file for visitation. When he gets visitation, then you can see your grandson. For a grandparent to have standing in this situation to file for grandparent visitation, there must be some action filed. That action would be that of your son to get visitation.
