Income tax garnishment

My wife was served with a writ for garnishment of income taxes. Can all of our refund be taken even if I am not part of the garnishment? I am the one who payed most of the taxes since she worked part time. The House is in only my name so any property taxes are payed by me.

spouses are not responsible for the other one's debts. So, if you filed together, the most that can be garnished is one half. Your wife would have to file an objection and state the reason for the reason for the objection.
