Legal Question in Civil Rights Law in Michigan

Hello, I had a customer come in and drop their phone off for repair. They signed a contract stating after 30 days the phone is mine to do what I want with it. i sold the phone on eBay after almost 2 months without any contact from the guy. I sold it with the sim in it, and I guess there was financial data on it. He said he is taking me to court for sueing me for his phone making calls and sending texts and to finish his contract and to pay for the phone. What can I do?

Your defense will be that the contents of the phone became yours when the phone was relinquished. You will have to answer the complaint and defend the case. Depending on the amount he is suing for, you probably want a lawyer to represent you. Consider it a cost of doing business. Modify your forms to make sure that they are very clear that the contents of the phone, data, etc. become yours if the phone is not retrieved in a timely manner.
