Legal Question in Construction Law in Michigan

Collecting on a judgement

We won a judgement against a

builder in a civil suit. How do we

collect on it? The builder says he will

not pay it. He works for cash and

doesn't have any assets except his

new home that he built with our

money that he took from our

construction loan. Our current

lawyer is willing to try to collect if we

want to hire her for it. We have

already paid her $35,000 for her

representation in the civil suit and do

not want to go into debt any further

with out getting money back. How

can we force the builder to pay the

judgement without paying a large

fee to an attorney? Is this

something we can do on our own? If

so, How?

You have a number of options. THrough the court system you have a number of options in enforcing the judgment. You should probably have an attorney do the work for you. You may be able to find one that will do it on a contingency.

A contingency fee for collection on a judgment would be about 10%- give us a call we can make a referral. You don't pay out of pocket.
