Legal Question in Credit and Debt Law in Michigan

garnishing MY wages

My estranged husband did not take care of a hosptial bill until staue of limitation was up and now they are garnishing my wages also he atained a lawyer and now I have to pay part of his dept. When he went to court I was not informed about this matter. Do I have any recouse on this. Iam a single mom with an income of about7500.00 a year. I told him about this bill every time it came in the mail and he would just fly off the handle and not take care of it..The bill was for hospital care for our daughter after an accident. The insurance company said all he has to do is call his insurance company..Why should I have to help pay this when I was the one trying to get him to pay it in the first place. And how can they garnish my wages when I never knew about any legal matters of this bill.

Re: garnishing MY wages

You are responsible because you are one of the parents, and the hospital is entitled to come after you if he doesn't pay.

The problem is that the divorce is between you and your Ex, not the hospital. so your best bet is to get an attorney (call legal aid, if you can't afford one, on $7500/year you should be eligible) and get the responsibility sorted out AS BETWEEN THE TWO OF YOU.

If your divorce agreement covers this, then you can use that in dealing with the hospital, but don't expect them to be bound by it.

How medical expenses are to be divided should have been dealt with in the divorce judgment.
