i got your reply, and thanks for the info and what i did say was i asked her to lend me the phone and i used it for about 3 months BUT i paid for those 3 months i paid with money orders and gave them to her. then i asked her to cancel the phone, she never did so what do i say in court?

Basically: you tell the court you borrowed HER phone, you paid her for all of your usage, you gave the phone back and never used it again.
If that's what happened there's no liability on your part for her phone.
