Legal Question in Criminal Law in Michigan

3rd degree retail fraud

I got caught shoplifting with a girlfriend of mine. I am only 18 years old and I'm basically freaking out. Ive never had a ticket, never been in trouble with the law what so ever. This is my first time. I was arrested and now have to go to court. I dont know what to be expecting when I do go. I dont want this to be on my record and its a huge concern for me that it will be. Can anyone help?

Being concerned is good, but this is not the end of the world. You should talk to a criminal defense attorney who practices in your area re: your legal options. If you can't afford an attorney, apply for a court-appointed attorney at your arraignment.

One option that may exist to resolve your case with an eventual dismissal is to use the process in the Holmes Youthful Trainee Act. (Go to www.prosecutingattorney.info ... click on the Legal Definitions button, and scroll down to "HYTA" to read up on it.) HYTA may be the perfect solution. It's age-limited to people between 17 and 20. Although it's a discretionary thing for a judge to go along with, a first-offense misdemeanor theft case is pretty typical for HYTA status. The benefot for you? If you successfully complete the probation terms, the court dismisses the entire case and you can say that you were never convicted.

You should definitely retain a lawyer who can negotiate with the prosecutor so that the charge does NOT appear on your record forever - you don't want a silly charge like this to follow you around, especially today, when 90% of employers perform criminal background checks, along with colleges, etc.
