extenting probation

my probation expires in dec,2008,but po wants to extent due to an amount of money owed to criminal account, attys fee and other court cost, I had court appointed att. I don't have the money to pay, I am receive SSI and general assistance, food stamps and energy assistance. Can this be done beyond my sentence from the court. I served six months jail time.

Re: extenting probation

Yes. A court can extend probation beyond what was initially imposed if there are probation violations, if restitution or other assessments are not paid, etc. but the court cannot put you on probation for longer than is statutorily allowed for your crime. Most felonies have a 5 yr max for probation, and most misdemeanors have a 2 yr max.

The fact that your income is from SSI, GA, etc does not mean that your court assessments and restitution don't have to be paid. You are not immune to the court's sentencing order. The court can order a weekly/monthly payment rate that is commensurate with your income, regardless of the sources of income.
