larceny
my wife recently left her job to go to competitor and now her past employer has filed charges of larceny for taking catalogs and e-mails with artwork that is not copyrighted or patented. does the employer have a case for this?

Yes. She could also be charged with embezzlement. The employer doesn't have the case once a warrant is issued - it belongs to the state.
She should not discuss her situation with anyone until she has talked to a lawyer.
