Legal Question in Criminal Law in Michigan

I live in Michigan and a friend and I were caught shoplifting. It was a stupid one time mistake for both of us, but because i was 17 I was arrested and am now begin tired for as an adult. I m worried that I'm gonna have a record and have to put down that I was arrested when I apply for college or job. So I want to know if there's a way to get my case transferred down to a family court because I'm still 18 and technically a minor.

No. Your case is in adult court and will stay there. There are a few statutes that apply if you are a first offender and you can keep it off your record. Contact me at kliszlaw.com to discuss. Tim Klisz

In Michigan, Family Court "delinquency" cases are for offenses committed by people who were under 17 at the time of the offense. Once you turn 17, all criminal behavior is handled in "adult court". There are different age thresholds for different things; not everything changes when you turn the magic 18 years of age. For one; you can drive at 15 or 16, right? You can consent to sexual activity at 16. You can't drink until you are 21. Etc. And as the other attorneys said, there is a youthful offender probation option called HYTA that you can apply for (which the judge can choose to give you, but it isn't guaranteed) where your charge can be dismissed after you successfully complete probation. Talk to an attorney in your area about it.
