Legal Question in Criminal Law in Michigan

public urnation

My husband was issued a ticket last night for public urnation. He is an over the road truck driver and stopped at a rest stop and decided to pee on his truck tires. Don't laugh. Anyway he got caught and the police officer gave him a ticket. He tried to pay the fine but when he called the county clerk in Battle Creek, MI he was told he would need to show up in court. He is being told that he could get charged as a sex offender. HELP what should he do?

Re: Public urination

I would call the Battle Creek prosecutor and arrange for a convenient date for your husband to appear in court to answer this charge. Do not allow the court date to pass.

Its possible that the court would be willing to take a plea under advisement with the prosecutor's consent which would result in no public record of the charge.

A local attorney can better advise you of your options.

It would be unlikely that your husband would be charged with a sex offense given the information you provided.
