Legal Question in Criminal Law in Michigan

Years ago I plead no contest to attempted home invasion in the 2nd degree. My lawyer suggested this was my best route. My sentence was differed for 1 year, and I was told I would no longer have it on my record after that time. It is several years later and I am looking into buying a hand gun but my record shows a felony. Do I have any options?

You can seek to have the conviction expunged if more than 5 years has passed. (Check out Michigan Legislature website and look up MCL 780.621)

But from your description, it sounds like it shouldn't be there to be expunged. So before going that route, you can contact the court records office and pull the file to see exactly how the judgment was entered.
