Legal Question in DUI Law in Michigan

What happens in the case of a MIP violation of probation?

My boyfriend has recieved a MIP for driving with open alcohol in the car. He failed to write is to his probation officer and was given a fine and is subject to monthly drug testing. He recently missed one of his testing dates and is due to appear in court next week. He was told he could face jail time. Is that correct? What else could he face?

Yes, you can face jail time and the possibility of sanctions to your drivers license through the Secretary of State. Call me if you would like a free phone consultation. I may be able to help you.

Sincerely,

For a second violation of probation, jail time is possible. Since the jails are full for the most part, WAM weekends or added community service is more likely if he makes sure all his current fines and costs are paid and any community service completed (documented) before he next appears in court.
