minor owi, possession of marjuana

my son was arrested for owi, (his bac was .03)also possession for marjuana (a very small amount less than 1 joint)blood tests for THC level has not come back yet. he's in 3rd yr of college and has never been in any kind of trouble.

A conviction doesn't note how intoxicated a person was or how much marijuana they possessed -it simply shows up as a conviction. If your son wants to find a job after he obtains his degree, he is going to want to keep the possession of mj (in particular) off of his criminal record. He should hire an experienced criminal defense attorney.

Any level of THC is enough for the highest charge of OUID which may be filed if his blood comes back with even a trace.

Because he has no record of drug use, the possesion charge may be kept of his record. With the low BAC, he may be treated under zero tolerance which results in a lower penalty.

There are other alternatives to OWI. More details involving the reason he came to the officer's attention would be helpful.
