Legal Question in DUI Law in Michigan

I am on probation for an MIP in Michigan that I received in April of 2010. I went out the other night after paying all of my fines and received another MIP for a BAC of .009. What can I do in court to get this dismissed? I know the MIP laws here are for a BAC of .02 or higher. I was not driving.

Let's see if I got this right.

You violated your probation and went out drinking directly after you were convicted of MIP and then got charged with another MIP?

.....and you want to know what you can do to get this second charge dismissed? ... Right?

You have us confused with magicians.

You are advised to have your mother drive you to your court date and not to wear lace-up shoes or a belt in the courtroom.
