Legal Question in DUI Law in Michigan

Tonight I got pulled over under suspected DUI. I passed all they tests and the cop searched my truck. He did not mention anything to me other than a zip-loc bag containing some pills (which I clarified to be aspirin). After he took down my info and I drove away I noticed that a can a beer that had been under a seat was now on top of the passengers seat.

My question is:

If a cop found an unopened can of beer in my truck and didn't say anything about it can I still be brought up on MIP charges?

He has my information, I am 18, it happened in Michigan. Also, I passed a PBT, although he did not tell me the reading.

Thank you

Yes you could be charged, but the evidence is still in your truck. I doubt this will result in a charge, but you have a good defense if you are charged. Visit kliszlaw.com to discuss. Tim Klisz
