Legal Question in Family Law in Michigan

child support

How are commissions, bonuses, salaries computed in determining child support in michigan? Are bonues computed, even when they are not a guaranteed income? My husband is in sales. He earns a small salary, car allowance, and commissions. he is entitled to bonuses if he reaches his goals (this frequently changes). Are bonuses computed? He has only been at his new job for 5 months. Will a judge consider his personal business expenses? Is there a minimum time he has to be employeed to determine what the child support award will be? His ex wife is taking him back to court and never allows him to see his son. He is a former police officer. He went from a straight salary to the above. We also pay for his son's medical insurance. Is this a factor? Thank you for your help. I appreciate it. We have court on May 2nd. Any information would be greatly appreciated!

Re: child support

All of your questions can be answered by your husband's attorney. As a former police officer, surely he knows better than to go to court without an attorney.

His attorney will be able to answers your questions using the Michigan Child Support Formula and the manual which explains it.

You waited WAY too long to ask these questions. You need to ask your attorney, who can explain it to you and look at the FOC site online. Lots of those questions are answered there.

At the end of the day, argue entitlement to everything, but try to mediate a reasonable amount of child support, for your son's sake.
