child support

I would like to get remarried but i am worried that my ex-husband will try to come after my new husband money for child support. Can he do that? There is a court order of no child support to be payed by either parent at this moment.

No. Even if an order for child support or separate maintenance were in place, only jointly own assets would be subject to the order. Whatever your new spouse brings to the marriage belongs to him unless he decides to create a joint title or otherwise share his assets with you.

Part of it depends on the terms of your Judgment and support order - if it was contingent upon you remarrying or not. However, I've never seen child support being contingent on such a thing - that is more for spousal support issues.

Child support is determined based upon your income and your ex's income, and of course, who has custody/visitation of the children most of the time. Simply because you remarry and your new husband has a job or money, does NOT entitle your ex to child support, or an increase in child support.
