Legal Question in Family Law in Michigan

custody

My daughter (17) just had a baby and she is the only person on the birth certificate, she thinks she needs a paper stating that she has physical custody of the child in case the father wants the kid for a weekend and she needs to involve the law to get the child back. Does she need something stating she if the physical parent and that the child resides with her?

Re: custody

It is usually a good idea to have custody, visitation and child support established. While paternity may not currently be established, it can be difficult to enforce custody when there is no court order stating as such. Additionally, for support and visitation, it is good to have that written in an order so that both parties know what should happen.

This can be accomplished by bringing a paternity suit and establishing custody, visitation and child support through that case. If the father of the child is willing to agree to everything, then it will be fairly easy to have agreements drafted regarding all these issues. But a cop is going to be hesitant to enforce custody without a court order.
