Legal Question in Family Law in Michigan

debt accumulated during divorce litigations

Here is a question that I hope to have answered . . . My husband and I have been going through a divorce for the last 9 months. My husband is quite financially set, he owns 2 businesses - (1 bar worth $250,000) (1 he bought during our marriage worth approx. $750,000). I had worked for my husband with a salary based on $300 a week.My husband is responsible for all household bills. He used to give me $300-$400 cash per week. All has stopped since the divorce started. To get by, I have opened a few credit cards with a maximum limit of $1,000 (that is all they would give me based on my salary). I used this to pay for bills that are in my name that he will not pay anymore. My question -- can he be responsible for paying these when the property settlement comes into play? I'm just desperate to get money in my hands. The simplest things that I used to do - such as getting a haircut/hair color once a month is not unaffordable to me. He chooses to golf, vacation, buy clothing, eat dinner out based on his $100,000 + salary. I live like a pauper.

Re: debt accumulated during divorce litigations

Do you have a lawyer? These things might be ordered in a temporary support order. Running up debt on your own is probably the worst thing you could do. The judge might order payment of the credit cards in the final judgment, but that is not guaranteed. I would seek an order for support, and quit running up the debt. You may need to consider bankruptcy AFTER the divorce is final. For more info, please contact my office at (248)851-3171.

It sounds like you may wish to get some type of order for temporary spousal support. I know you have a lawyer so you should discuss this with your present lawyer. If you wish to have a second opinion, etc. feel free to contact me at 248-353-9400. William S. Stern
