Legal Question in Family Law in Michigan

I am an international student in Lansing, Michigan since the last ten years. I was married in India last year,1998, and my wife and I are estranged. We wish to be divorced. What is the procedure? What should we do? We are both citizens of India, me on F1 visa, and she on F2 visa. Also she is currently in India, and does not wish to return presently. We would both like the least complicated solution as we have an honorable understanding between the two of us that a divorce is the best solution.

In general, foreign citizens MAY obtain a divorce in Michigan, provided the person filing meets the preliminary requirements of residency. A lawyer would have to look at your visa status to tell for certain. If your wife consents to the jurisdiction of Michigan courts, and either waives service or agrees to accept service from India, then the divorce will probably be permitted to go forward. Serious consideration, however, must be given to whether the divorce will be recognized in India. You need an Indian lawyer to tell you that. Also, if any real estate or property involved is outside of the States, the Michigan Court will not have jurisdiction to divide it.
