What legal right do i have to keeping my child from seeing an abusive neglectfull parent?

First, you have to look at your Divorce Judgment (if you are divorced) or your Custody Judgment (non-married) to determine what custody and parenting time arrangements are in place. If you want to change the parenting time or custody arrangements, you must file a Motion with the Court that handled the divorce or custody proceeding, and ask for a change in custody and parenting time based upon the abuse and neglect. However, you will have to prove that there has been abuse and neglect, or otherwise prove that there have been changed circumstances that require a revision of the custody and parenting time agreement. If you do not have a Judgment in place, the Courts are not involved unless you file a Petition for Custody or file for Divorce. www.altonlawfirmplc.com
