Legal Question in Family Law in Michigan

forced paternity testing and custody

I am a married woman who had a child who could possibly not be my husbands. The other man is trying to force rights on my child, does he have any legal rights even though my husband's (who knows about the affair) name is on the birth certificate? My husband has claimed my daughter and is currently paying for all of her needs and bills. Does the other man have any hold over us or no?

Re: forced paternity testing and custody

Hi there. I know that any child born during a marriage is considered legitimate (meaning that the father is the husband). I have never dealt with a situation where there may have been an affair during the marriage and the other male is trying to determine paternity. It is usually the husband filing for divorce and forcing the paternity action to not be responsible for the child. There have been several big court of appeals decisions regarding this question and I would have to research your question to give you a legal opinion. If you would like, you can contact me any time at [email protected] to discuss this case in more detail. Thank you for your inquiry and I wish you luck
