Legal Question in Family Law in Michigan

inheritance

My husband has been involved in a couple of affairs in our 15 years of marriage--none I can prove. My father has approx. 4 million dollars that my sister and I will inherit when my father dies. If I divorce my husband after my father dies will he have legal rights to the money after I inherit it? My father says he has a stipulation in the will but will it actually make a difference? I feel my husband is with me for the money only.

Re: inheritance

An inheritance can sometimes be shielded in divorce. There are other times it cannot. It depends on a number of circumstances. If your marriage is truly over, you should seek a divorce prior to receiving your inheritance. This is the only sure fire way to protect your inheritance. Re: inheritance

Work out a post nuptual agreement with your husband having him forego any of the inheritance proceeds. See a lawyer to put it together. Make sure that your husband has adequate representation to make sure the deal sticks. If he doesn't agree, then that tells you all you need to know. William S. Stern
