Legal Question in Family Law in Michigan

I'm involved in a relationship with a married woman. I want to protect myself and was wondering if a consent form exist concerning intimacy? If the relationship goes south I don't want her to claim I forced her? Also if she divorces can her husbands attorney subpoena text messages? Michigan is a no fault divorce state do I'm not sure the subpoena would matter, would it? This is a healthy normal relationship but this woman has A.D.D. And mood swings thus the question about the consent form?

1 Answer from Attorneys

1. Adultery is a felony in Michigan.

2. Being in an adulterous / cheating relationship is not normal or healthy.

3. During litigation, attorneys can subpoena text messages if they exist.

4. Consent forms are sometimes signed without actual consent. They are challenged all the time.

If you want better protection, it is best to not be involved with a person with whom you feel that protection is needed.
